Regulatory framework

Applicable legislation

UAE cosmetics regulatory framework

Cosmetic products sold in United Arab Emirates (UAE) are regulated by the following legislations:

  • Technical guidelines for cosmetics and personal care products by Dubai Municipality
  • GSO 1943:2024 : Safety Requirements of Cosmetics and Personal Care Products
  • Cosmetic Regulations MoIAT

Certain cosmetics must also comply with Halal certification requirements, ensuring that products do not contain ingredients prohibited under Islamic law (e.g., alcohol, pork derivatives).

Product scope

What type of products are cosmetics?

UAE cosmetic products

MoIAT defines cosmetic products as "Any substance or mixture intended to be placed in contact with the external parts of the human body (epidermis, hair system, nails, lips, and external genital organs) or with the teeth and the mucous membranes of the oral cavity, with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance, protecting them, keeping them in good condition, or correcting body odors."

It is important to note that products intended for therapeutic use (e.g., treating or preventing diseases or affecting the structure or function of the body) are classified as drugs or medical devices, even if they also affect appearance. Some personal care products may also be regulated as food supplements, consumer products, or over-the-counter (OTC) drugs.

Claims made regarding a certain product can often determine how the product is going to be classified.

Example non-cosmetic products

Examples of Non-Cosmetic Products

  • Product containing substances which restore, correct or modify physiological functions by exerting a pharmacological or metabolic action
  • Products intended to be used with invasive techniques
  • Product intended to be used with special device to induce a deeper penetration

Examples of Non-Cosmetic Products in UAE

  • Acne treatments
  • Eczema, Psoriasis, Dermatitis treatments
  • Rosacea or weakened/damaged capillary treatments
  • Products for relieving tired, swollen, heavy legs (e.g., varicose veins)
  • Hair loss and Alopecia treatments
Regulatory requirements

Requirements

UAE cosmetic registration requirements

In Dubai, United Arab Emirates (UAE), cosmetic products need to be registered with the Dubai Municipality's Health and Safety Department (HS-D) before being sold and distributed in the UAE market.

The registration ensures that products are safe for human use and meet government standards. If the product meets the guidelines set by Dubai Municipality, it will receive a product registration certificate from Dubai Municipality, once it is approved or registered, as well as a conformity certificate from MoIAT.

Regulatory Categories

Cosmetic products are divided into categories based on risk levels: low-risk, medium-risk, and high-risk products. The category depends on ingredients, usage, and the target audience. It is important to correctly classify the product.

Local Agent Requirement

Products must be registered through a local agent based in Dubai who acts as the official authorised representative with the regulatory authorities.

  • Conduct a safety assessment to ensure the product meets government safety standards
  • Approved products receive a registration certificate (valid for five years)

Post-Market Surveillance

Registered products must comply with post-market requirements, including:

  • Reporting adverse effects
  • Notifying changes in product formulation or labeling
  • Complying with recalls or corrective actions if necessary
