What is a Responsible Person in Canada?
Under the Canadian Cosmetic Regulations, a responsible person in Canada acting on behalf of a foreign manufacturer may be considered the manufacturer for regulatory purposes.
This role is distinct from that of a third-party consultant who simply prepares or submits Cosmetic Notification Forms.
Depending on the business arrangement, the Canadian manufacturer or importer may have obligations relating to:
- Cosmetic product notification to Health Canada
- Maintaining accurate manufacturer and importer information
- Ensuring compliance with applicable cosmetic safety requirements
- Addressing regulatory enquiries and requests for information
- Updating cosmetic notifications when required information changes
Foreign brands should ensure that the appropriate Canadian entity is identified and that regulatory responsibilities are clearly established.
