What type of products are cosmetics?

MoIAT defines cosmetic products as “Any substance or mixture intended to be placed in contact with the external parts of the human body (epidermis, hair system, nails, lips, and external genital organs) or with the teeth and the mucous membranes of the oral cavity, with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance, protecting them, keeping them in good condition, or correcting body odors.”

It is important to note that products intended for therapeutic use (e.g., treating or preventing diseases or affecting the structure or function of the body) are classified as drugs or medical devices, even if they also affect appearance. Some personal care products may also be regulated as food supplements, consumer products, or over-the-counter (OTC) drugs.

Claims made regarding a certain product can often determine how the product is going to be classified.

Examples of Non-Cosmetic Products:

Product indicated to prevent, cure diagnose, or alleviate a disease or its symptoms

Product containing substances which restore, correct or modify physiological functions by exerting a pharmacological or metabolic action

Products intended to be used with invasive techniques

Product intended to be used with special device to induce a deeper penetration

Requirements

In Dubai, United Arab Emirates (UAE), cosmetic products need to be registered with the Dubai Municipality's Health and Safety Department (HS-D) before being sold and distributed in the UAE market. The registration ensures that products are safe for human use and meet government standards. If the product meets the guidelines set by Dubai Municipality, it will receive a product registration certificate from Dubai Municipality, once it is approved or registered, as well as a conformity certificate from MoIAT.

Regulatory Categories

Cosmetic products are divided into categories based on risk levels: low-risk, medium-risk, and high-risk products. The category depends on ingredients, usage, and the target audience. It is important to correctly classify the product.

Local Agent Requirement

Products must be registered through a local agent based in Dubai who acts as the distributor.
